(Norman, OK) Keith Kimmel, the man who filed a lawsuit earlier this year against the State of Oklahoma’s Tax Commission to secure a personalize license plate, says he was the victim of a gay bashing at the hands of the Tulsa, Oklahoma Police Department this weekend and has filed a complaint.

On Monday March 29, 2009, he filed a complaint by US Mail with the Internal Affairs Department of the Tulsa Police Department, claiming that he had been dragged across a parking lot, punched in the testicles and verbally assaulted by officers of The Tulsa Police Department after being involved in a fight at a Tulsa gay bar. The complaint included pictures of injuries Kimmel sustained in the incident. The complaint was filed by mail after Kimmel was unable to reach the Internal Affairs Department all day by telephone to find out how it could be faxed or e-mailed. “I would like to get this information into the hands of the Internal Affairs Officers as early as possible, but I have tried calling all day and have been directed to voicemail. I tried calling various other offices within the department, but they continually redirect me back to the Internal Affairs number that no one answers”, Kimmel said.

Kimmel says he isn’t sure if the incident comes as retaliation for his earlier suit against the state. “I do not know if someone in the Tulsa Police Department has taken it upon themselves to dole out justice in their own way because of the suit, but what I do know is there has been alot of media coverage about the case in Tulsa, and I think its something that should at least be looked into. Regardless of why it happened, it was completely unacceptable and unprofessional. I am currently seeking the advice of an attorney on the matter and will pursue the internal complaint procedure of the Tulsa Police Department to the fullest extent possible in the meantime.”

In the complaint, Kimmel asks the Tulsa Police Department to utilize the recently passed federal hate crimes legislation to ask the Federal Bureau of Investigation to help investigate the incident, despite the fact that Oklahoma State Senator Steve Russell has recently introduced legislation designed to allow Oklahoma to “opt out” of the new law. “Senator Russell may belive that the protections of the new federal hate crimes law are not needed here in Oklahoma, but I think I have just learned how sorely they are needed in a very personal way. This is not an issue where TPD should be allowed to investigate itself, an unbiased party should be brought into to examine the incident throughly and through an unbiased lens.”

I really wish I didn’t have to make this post, but unfortunately, I do. Unlike many folks I encounter, I have a code of ethics and morals and I believe in true equality. Many folks seem to have this hypocritical habit of supporting things like free speech and equality only when it suits them or their interests, or only when the topic in question is not too controversial or only so long as certain people they place upon pedestals don’t object. This is not the mark of a patriot, a freedom fighter, an independent or someone worthy of support. Its the mark of a coward, a hypocrite, an imbecile and folks who ought not to have the right to inhabit our country.

I don’t hate very many people or organizations, but The Westboro Baptist Church (WBC) is one fundamentalist Christian organization I do reserve a special spot in the deep, dark bottom of my cold, dead heart for. WBC is better described as a cult and its a disgusting little organization run by a deranged lunatic who appointed himself to be a preacher named Fred Phelps. The flock is comprised mostly of members of his family. I truly hate this organization, its membership, its leaders and what it stands for.

Being a gay homosexual myself, I am one of the groups of people they have targeted. So far, I have had a couple of run-ins with this organization, the most recent of which was when they came to Moore, Oklahoma and decided to picket Moore High School. Moore has alot of gay youth, as one friend of mine so politically incorrectly observed, “Moore is where all the bottoms come from.”. There is a video about the protest that I got involved in on my YouTube channel.

Now word comes that The Supreme Court of the United States (SCOTUS) is going to hear an appeal regarding a lawsuit filed against him Phelps for WBC’s activities. One fine day in 2006, Phelps decided to picket the funeral of a dead US solider in Maine with their usual vile message of hate. The family sued WBC and Phelps and was awarded the family over $11 million in damages for emotional distress. The judge reduced the award to $5 million, then a federal appeals court threw out the award all together. The family now appeals to SCOTUS to reinstate the damages.

This is an important case because we are about set a key precedent. That family deserves the money, that I will tell you. But unfortunately, if they are awarded those funds, it will come at great expense to all of us. Because the case will not just decide if they get the money, it will decide if free speech extends to funerals. While most decent people know that a funeral is no place to make a political statement, this is not about decency – of which Phelps has none – this is about freedom of speech. As we should all be aware, the right to speech in this country includes the right to speak at times when it is not socially acceptable (at a funeral) and also the right to say unintelligent, disagreeable, stupid things (as WBC does early and often). As we should also be equally aware, rights are have often been lost by taking a well-meaning step towards silencing a highly offensive message in the name of cleaning up the public forum.

Fred Phelps is an old man, soon he will be in the ground dead and no longer voicing his hatred for all. WBC has not been very successful in recruiting new members, either. When his family dies off, so to will his church and its vile message of hate. While the message Phelps and WBC have for the world is annoying and undoubtedly painful for those who have to hear it, it is not worth gutting the first Amendment over to rid ourselves of it! If we start saying that objectionable or offensive speech is not allowed at funerals, we have just set a dangerous precedent that you can bet will be promptly extended to other areas – like churches and other religious gatherings. Will it be illegal for homosexuals to protest WBC while they are in session if SCOTUS decides in favor of the family? Thats a real possibility if SCOTUS finds in favor of this family.

Many people are going to argue that funerals are off-limits and that no one has the right to come into a funeral and make a statement. In other words, SCOTUS should find in this family’s favor because the ends (stopping people from being assholes through speech at funerals) justify the means (making it illegal to be an asshole through speech at places where such conduct is prohibited by law). In one way, they are correct. Funerals are closed events and there should be a legal right to exclude undesirables. Funerals, when held on private property as they usually are, are off-limits to anyone who does not have permission of the real property owner to come onto that private property. All that is needed is for the property owner to tell the Phelps that they are not welcome and ask them to leave. If they don’t, a phone call to the police will result in an arrest for trespassing.

But if they stand beyond the property line on public property or on the property of someone who allows them to be there, then that’s fair play. Legally, there is no sound argument to be made for silencing WBC so long as they stand beyond the property line. That wont keep them from sending their message, and the best thing to do would to be to use a very large piece of property, so that the property line is far enough away that the Phelps are out of sight and out of mind. If this case is about protecting the privacy and sanctuary of funerals, this will be an adequate fix to the problem. But I suspect alot of people want to see this family win to silence the Phelps and thats not an action that should be undertaken.

I must say that in this case, I support the right of WBC to speak because it’s a right granted to all citizens of this country – even at funerals and even when the message being spoken is morally repugnant and devoid of value. I hope that SCOTUS, with its conservative makeup, makes this connection. True conservatives tend to understand these types of arguments and will see them under the Castle doctrine, so there is hope that common sense will prevail.

We must resist the temptation to take feel-good actions in extreme cases that have far-reaching consequences. Part of not being a hypocritical coward is having the courage to defend people you truely hate when their ability to remain equal is threatened. In this case, the equality of WBC and Phelps is being threatened in a manner that threatens our collective right to free speech. This I cannot and will not be a part of supporting.

Gonna be a short post tonight, kiddies. Yesterday, I finished downloading all four seasons of Dexter and I am still watching them, so I am gonna cut right to it:

So I was playing with my new iPhone and something came across the Tweeter (thats what I call Twitter) from News9 asking followers to vote on whether or not Ronald Reagan should be put on the $50 bill. Out loud, I uttered “What the fuck?” and clicked the link, which was broken. So I did a Google News search and – sure enough – one idiot in Congress (Patrick McHenry) is wanting to put Ronnie on the $50. I know he is a hero of the conservatives and all, but this is just ridiculous.

As the country is going bankrupt, you have these idiots out there arguing about whose face should be printed on the increasingly worthless paper. Imagine the irony! What a joke. Tell ya, folks: the tea party movement may be onto something. I think its time to show the bastards the door.

Some of us are hot. Some of us are smart. A very few of us are both hot and smart. I know someone in that last category. I met him a few weeks ago, for obvious reasons, not the least of which is he would kill me if I were to do so. He is hawt as hell, probably one of the most beautiful boys I have ever personally met. I saw some photographs of him and he has one of the most amazing bodies I have ever seen. If I were still shooting porn, I would have immediately gotten out my checkbook to get him in front of my camera.

I wont say his name here (also for obvious reasons) and for many reasons, we are friends quietly and my interaction with him is mostly done under assumed names and aliases. This is necessary because he has appearances to keep up and I am the sort of person who sinks careers and destroys business ventures just by virtue of association. I have spent a fair amount of time talking to him and I enjoy his friendship and conversation. I would be lying if I said I did not find him attractive, but I also know it will only ever will be friendship, for he is married and he and I would never work in that way. In the past, I have been bad about avoiding fucking my friends, so this is an exercise in self control. He is one of the smartest people I know and my knowing him and the conversations we have  as a result have caused no small amount of self reflection.

He is hot and smart and unlike many hot guys (smart or not), he doesn’t flaunt it. He’ll take the compliments and he doesn’t mind the attention and will even bask in it, but he doesn’t feel the need to remind you of the fact that he is hotter than you at every chance. Such an approach to life is refreshing, I must admit. Nothing is worse than somebody who is hot and knows it. So this article is not about me fawning over him or putting him on a pedestal and dressing him up. Its about my self-reflection and musings on the title: what if I were hot?

Everyone has a few things going for them and a few against them. One of the gifts I have is the ability to give myself honest self appraisals. Doing so has lead me to the following determination: I am smart. Not an opinion held by just me, even most of my enemies admit this freely when they are being candid in their thoughts about me. People who like you will often patronize you and tell you what they think you want to hear or what will get them what they want. If you want to know how you are really projecting yourself or how you are come off, then ask someone who hates you. Be prepared, you may not like what you hear, but then again, that’s probably why you are enemies.

But while I am smart, I am enough of a realist to know that I am not hot. Well, there is one truck driver I met at The Finishline from somewhere out in Indiana who thinks I am hot. I got drunk one night really bad and wound up swallowing his cock. I was so drunk that before that night was over, I’d get arrested, have three criminal charges filed against me and wake up in the hospital tied to a bed and being forcibly treated after lapsing into a coma at the county jail. So I have to say that the trucker finding me hot was an isolated incident.

I am not cute – but what if I was? The guy I talked about at the start of this article is hot and smart and he has a wonderful middle class life. Does he have it because of his looks? Do I not have it because of my looks? This is the million dollar question, to be certain. I have wondered about this early and often. He is just as direct and in your face as I am and when he thinks something stinks, he says so. Only he says fuck you with a smile, and I say “fuck you” aloud when the time comes. This is a difference between us, but when you look right at it and compare the way he approaches things and the way I approach stuff, we are not all that different. He is extremely manipulative and self-focused, as am I. We are both focused on money, success and power. Yet with all these similarities, he has the life and I do not. While he will tell you his not rich, he has it going on. He makes money while he sleeps and he can go out on the town every night of the week and not blink. By contrast, I have a half a dozen corporations in bankruptcy and a personal life in disaster.

If I were hot, would I have the kind of life I want? Would I have his life? Sometimes I think it all boils down to looks in our community. Most homosexuals will tell you its not a choice to be gay. I disagree with this, I think for some people it is a choice and I think others they are born that way. But we all know that we cannot control the way we look, at least not without much plastic surgery. In a community that screams for equality because we cannot change who we are, why would I be excluded from the community because of my looks. I know I am slightly more abrupt than he is, which may be what holds me back in life. While he just gives the fuck you smile, I put it into words. Perhaps that subtle difference is what separates us.

Who knows. I am pretty sure that my looks are not the only thing holding me back. There are plenty of popular ugly people in our community. Yet there are also plenty of popular assholes in our community. So what gives? Perhaps I am just cursed. These are the kind of thoughts that keep me up at 2 AM in the morning, watching Logo and Queer as Folk re-runs posting on my blog that no one reads or cares about.

Today is set to be a busy day as I do more errands than I have done all year in a single day. Yet I can’t sleep, I don’t want to sleep and I just want to sit here and be miserable. I want to sit here and think about how my life has been a complete failure. I am keenly aware of the fact that I am 28 years old, in two years my life will be over (as every faggot’s life ends at 30) and while I am doing the things successful fags do, I dont feel it. I don’t feel successful. I am not happy. I am not where I want to be in life. I have no plan to get there. Today should be a good day, for it marks my burial of a hatchet with someone. But I don’t feel it. More than anything, I want a nice, stiff drink. Looks like I am going to be having booze for breakfast – again.

Despite the fact that I have spent more than a thousand words writing about it, I really don’t care. Why should I? I am cursed. I am doomed to suffer in this life. Maybe next time, I will be a cute little faggot that everyone wants.

Most thinking people in the United States (all ten of them) now admit that Wal-Mart is the great Satan of retailing. And even some of the less intelligent people on our planet realize it as well. So then why is Wal-Mart still here, why is it still expanding, why haven’t we gotten rid of this disease that plagues us? Its simple, really. People are selfish. They know what shopping at Wal-Mart does and they don’t really care.

So what is so bad about Wal-Mart? And why is shopping there so bad? And most importantly, why are the people who shop at Wal-Mart so bad?

First off, just try going to the hardware department and finding anyone who knows anything about hardware. You won’t find it. In fact, you’ll be lucky to find anyone who can even tell you where something is. While you are in the hardware department, try to find a plunger made in the United States. Wal-Mart is partly responsible for the increasing rampant stupidity that infects our country.

    Wal-Mart has destroyed good brands that made quality products – like Rubbermaid – which cost a good many jobs that paid well by constantly forcing US jobs overseas. Our country has lost hundreds of thousands of good paying jobs with good benefits and retirement plans, to be replaced by low paying dead end jobs at Wal-Mart with no benefits and no retirement.

    Speaking of benefits and retirement plans, do you know what Wal-Mart tells its employees to do when and if they complain about not being able to afford medical treatment? Wal-Mart must give them a discount on their insurance of something, right? Nope. Instead, Wal-Mart sends them to the welfare office where our tax dollars provide – at no cost to Wal-Mart – health coverage, housing, food and retirement.

    We all know the crimes of Wal-Mart. They have been extensively covered in the media and elsewhere. I started to rehash them here, but there is no need. Those who continue to say “Hey, what’s so bad about Wal-Mart?” are simply burying their heads in the sand so that they don’t have to face the fact that their continued patronage of Wal-Mart is ruining our country.

    Bottom line: If you shop at Wal-Mart, you are a selfish prick. When you shop at Wal-Mart, every dollar you spend screams “I want my plastic crap from China for a few pennies less than anywhere else, and I don’t give a damn how many people die, lose their jobs, get thrown out of their homes or get sold into slavery to make it happen. I also don’t give a damn how bad my country gets screwed, because I am more important, my needs wants are above all and I am what matters – all that matters.”

    Most people with any intelligence whatsoever will admit to you that our public schools are failing their students miserably. Every day, students graduate ignorant of how our country works, how laws are made and how to drive, among many other things. And just because you have a degree on your wall, doesn’t mean that you’re any smarter. A study released in 2005 by the U.S. Department of Education shows that only 25% of college graduates were “proficiently literate,” that is, “using printed and written information to function in society, to achieve one’s goals, and to develop one’s knowledge and potential.” More discussion on this study can be found here.

    One of the things many people seem to be ignorant about is the name of the country they live in. They seem to erroneously refer to this country with one word: America. Yet – and I know this may come as a huge surprise to some of you – there is no country called “America”. Not now, not in the past – never! It never existed. EVER! Yet everyday, we hear people refer to this mythical place. We also have TV shows named after it like American Morning. People refer to those who live in the United States as “Americans”. Folks refer to American universities, American film, American celebrities, American culture and on and on. And then there are Native Americans. And on Oklahoma’s license plates, its used in the state’s latest marketing slogan “Native America”. When will the lunacy stop?

    The country “America” does not exist! And I blame the public schools for this incompetence because they provide children at early ages with books, usually titled “American History”. And while there is a land mass known as the Americas (comprised of North America and South America) these books almost always cover United States history under the title of American History. No wonder kids think they live in America. These are people (textbook authors) should know better! They should know that children are impressionable when young and when you fill their little heads with incorrect information they will never unlearn it.

    Its called The United States of America. Or just United States would also be acceptable. But not just America because that refers to a country that is not found on any map, or any globe and instead refers collectively to two entire continents. Lets try to be intelligent for once and use the correct name to refer something.
